V.K. Jain, Presiding Member—The petitioner / complainant took a housing loan from State Bank of Bikaner & Jaipur for a construction of her house. The said house was got insured by her to the extent of Rs.15.00 lacs for the period from 24.2.2014 to 23.2.2015. The case of the petitioner / complainant is that she went out of the town on 24.3.2014 and when she returned on 02.4.2014, she found that the rainy water had entered her house damaging the same at various places. A claim was therefore, lodged by her with the respondent company. After inspection by the surveyor, a sum of Rs.1,02,979/- was credited by the insurer in her account, though as per the estimate given by the surveyor of the complainant the cost of repair was Rs.6,04,000/-. Being aggrieved from the refusal of the insurer to pay the whole of the amount claimed by her, the complainant approached the concerned District Forum by way of a consumer complaint.
2. The complaint was resisted by the insurer which alleged that the loss to the complainant was rightly assessed at Rs.1,02,979/- by the surveyor and the said amount had been duly paid to the complainant.
