Rekha Gupta, Member—The above noted First Appeal has been filed by the Appellant / opposite party against the order dated 26.04.2017 passed by the State Consumer Disputes Redressal Commission Gujrat, Ahmedabad (in short, the State Commission) in Complaint No. 56/2011.
2. The respondent / complainant is a manufacturer and Dealer / Exporter of D.O.C (De Oil Cake). The appellant had taken Standard Fire and Special Perils insurance policy also covering risk of spontaneous combustion and earthquake for the period 4-1-2009 to 3-1-2010 and had paid premium of Rs.1,99,738/-. During the policy period while sorting stock for export, the respondent found that stock of rape seeds of 7494.255 MT was black and charred. The respondent checked all the godowns where the stock of DOC stored. The respondent found that stock of DOC of groundnut was also black and charred. The entire stock was badly affected and was no longer fit for export. The respondent then immediately informed the appellant / insurance company about the incident and submitted a claim for Rs. 68,77,500/-.
