Rekha Gupta, Presiding Member—The present revision petition has been filed against the judgment dated04.11.2016 of the Punjab State Consumer Disputes Redressal Commission, Chandigarh (‘the State Commission’) in First Appeal no. 356 of 2016.
2. The facts of the case as per the petitioner/ complainant are that he was the owner of the car, Maruti Swift, bearing Registration No.PB-11-BB-0885; which was fully insured with the respondents/opposite parties, vide Policy/Cover Note No. LDH/2014/979331, and the same was valid from 03.06.2014 to 02.06.2015. On 06.05.2015 at about 5.00 P.M., while he was coming towards his house from Patiala side on the main Sangrur-Patiala Road, suddenly one bull came in front of the vehicle and to save the bull, he turned the vehicle on its right side; as a result of which one blue coloured Matador, being driven in a rash and negligent manner, came from the backside and in turn damaged the right side of the vehicle. In order to avoid a major accident, he turned the vehicle to extreme left side and it struck a tree.
