1. Challenge in this Revision Petition, by United India Insurance Company Ltd. (for short “the Insurance Company”), the sole Opposite Party in the Complaint, is to the order dated 18.07.2017, passed by the Odisha State Consumer Disputes Redressal Commission at Cuttack (for short “the State Commission”) in Miscellaneous Application No. 263 of 2017 in/and First Appeal No. 106 of 2017. By the impugned order, the State Commission has declined to condone the delay of 36 days in filing of the Appeal by the Petitioner herein, questioning the legality and correctness of the order dated 31.10.2016, passed by the District Consumer Disputes Redressal Forum, Sundargarh-II at Rourkela (for short “the District Forum”) in Consumer Complaint No. 7 of 2016.

2. Upon notice, the Respondent/Complainant is represented through his Counsel, Ms. Urvashi Basak.

Having heard Learned Counsel for the parties and perused the documents on record, we are of the opinion that the Insurance Company has made out a sufficient cause for condonation of the afore-stated delay and, hence, the State Commission committed a jurisdictional error in not condoning the same.
