ORDER

This first appeal has been filed by the appellant Marbles Centre International Pvt. Ltd. against the order dated 17.12.2015 of the State Consumer Disputes Redressal Commission, Puddicherry, (in short ‘the State Commission’) passed in CC No.2/2008.

2. Brief facts of the case are that the complainant/respondent purchased Italian marble and American Beige marble from the appellant and the material was despatched from Bangalore to Puddicherry on 24.05.2005 vide invoice dated 25.05.2005 and the same was received on 27.05.2005 at Puddicherry. On 06.06.2006 an e-mail was sent by the respondent that the Italian marble did not give any problem, however, the American marble inspite of good polishing did not produce the same effect as was present in the sample which was seen by the complainant/respondent at the place of the appellant. Appellant sent two members team to inspect to find out if any problem existed with the stone. Later on appellant received a legal notice dated 19.09.2006 and the same was replied by the appellant on 06.10.2006 denying all the allegations.
