M. Shreesha, Member—Aggrieved by the order dated 28.12.2016 in Consumer Complaint No. 429 of 2016, passed by the State Consumer Disputes Redressal Commission, UT Chandigarh (in short “ the State Commission”), Emaar MGF Land Ltd. preferred this First Appeal under Section 19 of the Consumer Protection Act, 1986 (in short “the Act”). By the impugned order, the State Consumer has directed the Opposite Party (hereinafter referred to as “the Developer”) to refund the amount of Rs.47,64,862/- to the Complainants with interest @ 15% p.a. compounded quarterly from the respective date of deposits; to pay compensation of Rs.2,00,000/- for the mental agony caused and to pay Rs.50,000/- towards cost of litigation. The State Commission has directed the awarded amount to be paid within a period of two weeks from the date of receipt of a certified copy of the order, failing which, the amount shall attract penal interest @ 18% p.a. compounded quarterly from the respective dates of deposits and interest @ 15% to be compounded quarterly on the amount of compensation and costs from the date of filing of the Complaint till the date of realisation.
