The absence of essential evidence such as a test report from the laboratory and the lack of presence of the respondent or an independent person during the inspection led to the court's decision that the respondent was not guilty of theft of energy.

Headnote:

Tampered Seals - Theft of Electricity - The court found that in the absence of a test report from the laboratory and the inspection being carried out without the presence of the respondent or an independent person, it cannot be held that the respondent was guilty of theft of energy.

Fact of the Case:

Ratio Decidendi: In the absence of a test report from the laboratory and the inspection being carried out without the presence of the respondent or an independent person, it cannot be held that the respondent was guilty of theft of energy.

Final Decision: Revision petition is dismissed, and the respondent is not held guilty of theft of energy.
