ORDER

Ashok Bhan, President - The New India Assurance Company Ltd. Petitioner herein which was the opposite party before the District Forum, has filed the present Revision Petition against the judgment dated 5.7.2007 passed by the State Consumer Disputes Redressal Commission Delhi (in short the State Commission) in appeal No. A-863/2004 whereby the State Commission has concurred with the order dated 17.9.2004 passed by the District Consumer Disputes Redressal Forum VIII. Sheikh Sarai-II, New Delhi (in short, the District Forum ) awarding a compensation of Rs. 1,85,620 (Rs. 1,00,000 and Rs. 17,450 having already been paid by the Petitioner) i.e., taking the liability at Rs. 3,03,070 together with Rs. 10,000 as compensation for mental tension and physical harassment and Rs. 2,500 as cost of litigation but set aside the interest awarded by the District Forum @ 9% on the compensation of Rs. 1,85,620.

2. Shortly stated, the facts are that the Respondent/complainant had taken, medi-claim policy in the year 1990 for Rs. 83,000. She got the policy enhanced to Rs. 1 lakh in the year 1997 and thereafter to Rs 3 lakh in 2000. She underwent a knee transplantation surgery in Breach Candy Hospital
