ORDER

J.M. Malik, (P.M) - The present complaint filed by Maruti Ispat & Energy Pvt. Ltd., is not maintainable because it pertains to a 'commercial transaction'. The complainant can be said to be a "consumer", as per the amended law, w.e.f. 15.03.2003.

2. Paragraphs 1, 2, 4 & 5 of the complaint are reproduced here, as under :-

"1. That the complainant is a private limited company and was approached by the opposite party with tall claims about saving resources, money and environment by using their High Pressure & High Velocity Gas Base Injection System (HP HV 100).

2. That the opposite party assured the complainant that their system was much superior in efficiency on innumerous counts and that it would help them in saving a huge amount of coal being used by the complainant in its factory and the sponge production will also increase. That the opposite party assured the complainant that by the use of their superior machinery, the complainant will be able to reduce the smoke, which will result in clean surroundings and they will also get the benefit of carbon credits, the use of their machinery will also reduce the fly ash and the power savings will also be big.
