ORDER

M.L. Sahni, Member (Oral)- The OP M/s. The Oriental Insurance Co. Ltd., (hereinafter referred to as the appellant) have impugned the order dated 4.11.2008 of the District Forum, K.G. Marg, New Delhi, whereby the Appellants have been directed to pay to the Respondent (complainant) a sum of Rs. 11,714 spent on his treatment and compensation of Rs. 35,000 for causing him mental agony, harassment and for deficiency of service, with Rs. 5,000 as cost of litigation.

2. None appeared on behalf of the Respondent today who had earlier put in appearance through his Counsel Mr. Gaurav Sharma, Advocate but did not choose to file any reply to the present appeal. We have heard the learned Counsel for the Appellant.

3. The facts as admitted by the appellant are that the Respondent obtained a Mediclaim Insurance Policy bearing No. 272300/2006/462 for the period from 5.12.2005 to 4.12.2006 covering risk upto Rs. 2.00 lakh each along with his wife Dr. Shivani Sabharwal (Annex B).

4. On way to his office on 1.6.2006 respondent suddenly felt onset of chest pain. He approached nearby Max Health Care Hospital, Saket, New Delhi and on the advice of the doctor of the said Hospital, he got himself admitt
