Veena Birbal, President—This is a complaint under section 17 of the Consumer Protection Act, 1986 (in short, 'the Act').

2. The complaint is an engineer qualified from Birla Institute of Technology, Ranchi and at the relevant time was engaged in the business of consultancy and trading of minerals. The aforesaid complaint is filed by him against Sitaram Bhartiya Institute of Science i.e. OP-1 which provides medical services to the public, Dr. D.K. Bhargava i.e. OP-2 a Sr. Consultant in the field of Gastroenterology with OP-1 & Appollo Hospital i.e. OP-3. Dr. Bhabha Nanda Das is OP-4. There are no allegations of medical negligence against OP No. 3 and OP No. 4. As per the complaint Dr. Bhabha Nanda Das i.e. OP-4 has saved the life of complainant. It is stated that OP-3 i.e. Appollo Hospital and OP-4 are impleaded only so that complete picture is brought before this Commission to bring out the allegations of medical negligence and deficiency in service on the part of the institute i.e. OP-1 and Dr. D.K. Bhargava i.e. OP-2.
