ORDER

Ms. Salma Noor, Member—The controversy in this case swirls around the question, "Whether the complainant is a consumer under the Consumer Protection Act, 1986 or not "

The present complaint has been filed by Karan Motors (P) Ltd., complainant who is a private limited company incorporated under the Indian Companies Act, and is engaged in the production of the automotive parts having strength of around 500 employees working in its factory. There are several departments and a foundry in the said factory which needs to be looked after. It is stated that the OP approached the complainant representing that they are specialised in the field of Enterprise Resource Planning (in short "ERP") a software that helps in streamlining and integrate business process and gives a real time access to business information at the click of a button, and is as easy as using an email. It is stated that since the complainant was earlier using multiple software and other resources in different departments/unit and it was difficult for them to coordinate among all of them, the complainant in order to make their resource planning more efficient and profitable entered into an agreement with the opposite
