ORDER

Anil Srivastava, Member - Shri Muneesh Malhotra, resident of Delhi, has filed this complaint before this Commission (for short complainant) under Section 17 of the Consumer Protection Act 1986 (the Act) against M/s. Era Land Marks (India), hereinafter referred to as OP, alleging deficiency of service on the part of the OP in not handing over the physical possession of the flat he had booked within the agreed time despite he having paid the amount as per schedule and praying for the relief as under:-

a) direct the OP to hand over the possession of Unit No.C-71, Block-C, 7th Floor, Era Redwood Regency, Sector-78, Faridabad, Haryana.

b) in alternative direct the OP to pay the current market value of unit no.C-71, Block -C, 7th Floor, Era Redwood Regency, Sector-78, Faridabad, Haryana i.e. @Rs.4000/- per sq ft. i.e. Rs. 58,80,000/-.

c) pass an order in favour of the complainant directing the OP to pay a sum of Rs. 4,41,000/- as compensation @Rs.5 per sq ft. as mentioned in clause 11.4 till the handing over of possession of unit C-71, Block-C, 7th Floor, Era Redwood Regency, Sector-78, Faridabad, Haryana.

d) direct opposite party to pay the interest @18% p.a. on Rs. 19,96,114/- from
