ORDER
R.C. Kathuria, President - Challenge in this appeal is to the order dated 16.9.2005 passed by the District Consumer Disputes Redressal Forum, Ambala whereby while accepting the complaint of the respondent-complainant, direction has been given to the appellant-opposite party to pay the insured amount of Rs. 1,10,000 with interest @ 10% p.a. from 24.1.2005 till payment and Rs. 1,000 as costs of proceedings, to the complainant. The above stated amount was ordered to be paid within 30 days from the receipt of the order.
2. The facts as set out in the complaint are that firm of the complainant deals in the distribution of medicines, general merchandise and other items which is carried out in its premises bearing No. 3763, Hospital Road, Ambala Cantt. The complainant had obtained insurance policy under cover note No. 826889 dated 5.7.2004 for the period 7.7.2004 to 6.7.2005 from the opposite party whereby all the stock items valuing Rs.15 lacs lying in the premises were insured with the opposite party against all risks of fire, flood, earthquake and rioting.
