S.N. Aggarwal, President - The appellant had purchase mediclaim policy from the respondents for the period from 11.7.2003 to 10.7.2004 for an amount of Rs. 1 lac.
2. It was further pleaded that the appellant fell ill and he was admitted in Dayanand Medical College and Hospital, Ludhiana (in short "DMC") on 7.1.2004, where he remained admitted till 24.1.2004. The appellant spent an amount of Rs. 4 lacs on his medical treatment, but the insurance policy was only for Rs. 1 lac. The appellant had lodged insurance claim with the respondents. All necessary documents were submitted. The respondents, however, repudiated the claim vide letter dated 12.7.2004. Hence the complaint for recovery of mediclaim amount of Rs. 1 lac. Compensation, interest and costs were also prayed.

3. The respondents filed written statement. It was not denied that the appellant had taken medi claim policy from the respondents for the period from 11.7.2003 to 10.7.2004. It was denied for want of knowledge if the appellant remained admitted in DMC from 7.1.2004 to 24.1.2004. No intimation was given by the appellant to the respondents at the time of his admission.
