ORDER
A.K. Bose, Presiding Member.—The appeal No. 162 of 2004, Moradabad Development Authority v. Smt. Vinod Yadav w/o Shri Rameshwar Singh Yadav, arising out of the complaint case No. 173 of 2001 and Appeal No. 163 of 2004, Moradabad Development Authority v. Ramvir Singh s/o Shri Dallu Singh, arising out of die complaint case No. 172 of 2001 are connected cases and therefore, are being taken up together for disposal. Appeal No. 162 of 2004 shall be the leading appeal.
2. Aggrieved by the two separate judgments and orders dated 13.11.2003, passed by the learned DCDRF-II, Moradabad in complaint cases No. 172 of 2001 and 173 of 2001, the appellant Moradabad Development Authority has preferred two separate appeals under Section 15 of the Consumer Protection Act, 1986 (Act 68 of 1986) on the ground that the impugned orders are arbitrary, perverse and are bad in the eye of law. They were delivered without proper appreciation of law and/or application of mind on the basis of surmises and conjectures and therefore, it has been prayed that the same be set aside in the interest of justice otherwise, the appellant will suffer irreparable financial loss.
