ORDER
Mr. A.K. Bose, Presiding Member.—Aggrieved by the judgment and order dated 24.10.2005, passed by the learned DCDRF, Ghazipur, U.P. in complaint case No. 31 of 2001 (original complainant No. 63 of 2000), the appellant/complainant Shri Vijay Narain Rai s/o late Shri Prasidhan Rai, r/o Village: Chandesh, Tehsil Mahania, PS: Miiaon/District Camoor, Bihar has preferred the instant appeal under Section 15 of the Consumer Protection Act, 1986 (Act 68 of 1986) on the ground that the impugned order is arbitrary, perverse and is bad in the eye of law. It was delivered without proper appreciation of law and/or application of mind, on the basis of surmises and. conjectures and therefore, it has been prayed that the same be set aside in the interest of justice and he be granted the relief sought by him in the original complaint No. 63 of 2000, otherwise he will suffer irreparable financial loss.
2. From perusal of the records, it transpires that the appellant complainant Vijai Kumar Rai expired during pendency of the appeal and therefore, his LRs 1/1 Shri Jagdish Rai, 1/2 Shri Ashok Rai, 1/3 Shri Santosh Kumar Rai and 1/4 Shri Sanjai Kumar Rai were substituted in his place on 14.5.2015.
