ORDER

S.N. Basu, Member - This is an Appeal directed against the judgement and order passed on 19.12.2007 by the North 24 Parganas District Consumer Forum in its D.F.Case No. 7/2007 directing the Appellant to pay Rs. 20,000 along with interest @ 12% per annum. Being aggrieved the present Appeal has been preferred by the OPs.

2. The facts of the case briefly are that being attracted by an insertion in the newspaper the Respondent/Complainant deposited application money of Rs. 5,000 with the Appellants on 28.10.2004. On 8.11.2004 the complainant paid further instalment of Rs. 15,000 being consideration money for the said flat. The Appellants issued a certificate of allotment dated 11.10.2004 in favour of the Respondent subject to the terms and conditions as contained therein. The Respondent visited the site office of the Appellants after some time to ascertain the progress of work and found to his utter dismay that the work had not been started at all. He was verbally told that the construction work would start soon and all necessary documents and other relevant papers would be handed over to him.
