Decided on : 30-01-2009
Mr. Anudyuti Maitra, Advocate, for the Appellant; Mr. D.M. Mathur, Advocate, for the Respondent
The main legal point established in the judgment is that the deficiency in service by the airline, leading to inconvenience and mental agony for the passengers, justifies the award of compensation under the Consumer Protection Act, 1986.
Headnote:
Deficiency in Service - Airline Passenger Rights - [Consumer Protection Act, 1986 - Section 21, Section 14(1)(d)] - The court discussed the deficiency in service on the part of the airline for not delivering the luggage on time, leading to mental agony and inconvenience for the passengers. The compensation awarded for mental agony and costs was upheld based on the inconvenience and hardship caused to the passengers.
Fact of the Case:
The complainant-respondents purchased a confirmed ticket for a flight journey, during which their luggage was not delivered on time, causing inconvenience and mental agony. The District Forum allowed the complaint and awarded compensation for mental agony and costs.
Finding of the Court:
The court found that there was a deficiency in service on the part of the airline for not delivering the luggage on time, causing inconvenience and mental agony to the passengers.
Issues: The main issue was whether the deficiency in service by the airline in not delivering the luggage on time justified the award of compensation for mental agony and costs.
Ratio Decidendi: The court held that the deficiency in service by the airline in not delivering the luggage on time amounted to inconvenience, hardship, and mental agony for the passengers, justifying the award of compensation.
Final Decision: The appeal filed by the airline was dismissed, upholding the District Forum's decision to award compensation for mental agony and costs to the passengers.
