ORDER

Chandrashekaraiah, President - This appeal is by the OP challenging the order dated 21.10.2008 passed by the DF, Davangere in Complaint No. 72/08 allowing the complaint of the complainant.

2. The husband of the complainant had taken a postal life insurance policy in his name from the OP on 9.11.2005 and the assured sum under the policy is Rs. 1,00,000. As per the conditions of the policy the monthly premium is to be paid at Rs. 650. Admittedly the insured has paid the premium without any default up to the end of July 2006. Thereafter as the insured was suffering from illness he was taking treatment in the hospital and ultimately he died on 25.10.2006.

3. After the death when the complainant came to know that there was a policy made a claim with the OP for payment of the assured sum. The said claim was repudiated by the OPs on the ground, as on the date of death, the policy was in a lapsed condition. This had made the complainant to file the complaint before the District Forum.

4. The DF accepting the case of the complainant allowed the complaint directing the Insurance Company to pay the assured sum of Rs. 1,00,000 with interest at 9% per annum from the date of repudiation till r
