S.K. Kulshreshtha, President (Oral)- This complaint has been filed against the non-transfer of the plot by the opposite parties to the complainant despite the complainant having paid a sum of Rs. 11,47,000.

The opposite party is a Company carrying on business in the name and style of Distinct Infrastructure Ltd. through its Directors Ramakant Vijayvegiya, Archana Vijayvergiya and Shahjad Khan at Bhopal. They had advertised availability of plots in colony called Panchwati Phase-III , Airport Road, Bhopal. Allured by the picturesque projection, the complainant booked plot No. A-27 of the area of 2700 sq. ft. for a total sum of Rs. 8,77,500, The allotment letter states that maintenance advance @ 15% of the plot area would be payable separately as and when demanded. The complainant paid in all a sum of Rs. 11,47,000 for the said plot but still after filing an agreement and issuing allotment letter they have not delivered the possession of the plot within two years as promised nor executed any conveyance deed in favour of the complainant. In short, despite having been paid a sum of Rs. 11,47,000, the plot has not been registered in the name of the complainant nor its possession g
