JUDGMENT (ORAL)
V.K. Jain, Presiding Member—Late Shri Dhirendra Singh, husband of the complainant obtained an insurance policy No.310261079 from the respondent Life Insurance Corporation of India for a sum assured of Rs.1 lakh. The proposal for obtaining the aforesaid policy was submitted by the deceased insured on 31.03.1994 and the policy was to commence from 28.03.1994. Late Shri Dhirendra Singh having been murdered on 11.04.1994 a claim in terms of the insurance policy taken by him was preferred by the complainant, which came to be rejected by the respondent vide letter dated 7/17 June 1996, solely on the ground that while submitting the proposal the deceased had not disclosed a previous policy which he had taken from the corporation, he having stated in the proposal that there had been no previous policy.
2. Being aggrieved from the rejection of the claim the complainant approached the concerned District Forum by way of a consumer complaint. The complaint was resisted by the corporation primarily on the ground that claim had been repudiated.
