1. This order will dispose of following three appeals i.e. Harjit Singh vs. Dr. Sanjay Garg and Others, First Appeal No. 126 of 2007. Dayanand Medical College and Hospital, Ludhiana vs. Harjit Singh and Others, and First Appeal No. 130 of 2007. Dr. Sanjay Garg and Another vs. Harjit Singh and Others. All these appeals are filed against the same order dated 12.12.2006 passed by the District Consumer Disputes Redressal Forum, Bathinda (in short the “District Forum”) and the same are disposed off in a single order. The facts are taken from ‘First Appeal No. 109 of 2007’ and the parties would be referred by their status in this appeal.
2. Brief facts of the case are that wife of the appellant Smt. Sukhpal Kaur aged about 41 years was suffering from hypo echoic-foci in her uterus which was detected in her ultra sound examination. She was brought in the hospital of respondent No. 1 known as “Delhi Nursing Home, Bathinda” on 5.9.2005 for check up and treatment. She was examined by respondent No. 1 and necessary tests were got conducted by respondent No. 1 which were found normal. Respondent No. 1 directed the patient to come on 7.9.2005 to undergo for operation.
