ORDER :

1. Aggrieved by the order dated 01.6.2011 passed by the Andhra Pradesh State Consumer Disputes Redress! Commission, Hyderabad in First appeal No. 507 and 860 of 2009, the original complaints have filed the present petitions purportedly under Section 21(b) of the Consumer Protection Act, 1986. The appeals before the State Commission were filed by the opposite parties to the complaint, against the order dated 04.05.2009 passed by the District Consumer Disputes Redressal Forum-III, Hyderabad, thereby directing the opposite party No. 1-Jubilee Hills Co-operative Housing Building Society to transfer the membership and allot the plot No. 571 in favour of the complainant and opposite party No.2, besides a direction to pay a sum of Rs. 10,000/-. The State Commission on a consideration of the entire gamut of the controversy raised in the complaint, relegated the complainant to the jurisdiction of the Civil Court by making the following observations:

    “To sum up there was a dispute in regard to nomination made by the deceased in favour of complainant and OP No.2. The society itself contended that there was tampering of name of OP No.2 and that fraud was played
