This appeal is directed against the order dated 4.12.2012, passed by the District Consumer Disputes Redressal Forum, Durg (C.G.) (henceforth "District Forum’) in Complaint Case No.285/2008, whereby the complaint filed by the respondent No.1/complainant, has been allowed and appellant/O.P.No.1/Insurance Company, has been directed to pay a sum of Rs.16,91,949/- to the respondent No.1/complainant within a month from the date of order along with interest @ 6% p.a. from the date of filing of the complaint till date of payment. The District Forum has further directed the appellant/O.P./Insurance Company to pay Rs.1,000/- as compensation for mental agony and Rs.1,000/- as cost of litigation to the respondent No.1/complainant.

2. Briefly stated, the facts of the complaint of the respondent No.1/complainant before the District Forum are : that on 26.2.2008, the respondent No.1/complainant purchased vehicle Chevrolet Captive bearing registration No.No.C.G.04-8656 from the respondent No.2 at the price of Rs.17,80,999/-. The said vehicle was insured with the appellant/O.P.No.1/Insurance Company and policy was effective for the period from 29.2.2008 to 28.2.2009. On
