JUDGMENT :
Mr. Justice N.A. Britto, President-By application filed on 10.5.2013, the applicant seeks to condone the delay of 62 days, in filing the appeal, against impugned order dated 12.12.2012.
2. We have heard Lr. advocates on behalf of both the parties.
3. Shri. Pai on behalf of the applicant submits that the certified copy was received by the applicant/OP on 8.2.2013. He further submits that the copy was then sent to the head of the applicant at Parle, Mumbai and the same was received by them on 11.3.2013 and thereafter the said head office sought advice from the lawyer about the filing of the appeal. Lr. advocate submits that the lawyer then drafted the appeal and forwarded the same to the applicant. Lr advocate submits that the applicant is facing severe administrative and financial crisis and in view of that several officials associated with the applicant have resigned and as such the applicant is facing genuine difficulty in collating documents and obtaining necessary instructions regarding the transactions which forms the subject matter of the appeal. He submits that the delay to be condoned is of 44 days.
