ORDER :
Mr. Justice Kalidas Mukherjee, President-This order relates to the hearing on admission of the appeals under Section 27A of C.P. Act. The appeals are barred by limitation of 139 days. The appeals being identical in nature were heard analogously.
2. The learned Counsel for the appellants relying on the provisions of West Bengal (Regulation of Promotion of Construction and Transfer by Promoters) Act, 1993 has submitted that the learned District Forum had no jurisdiction to entertain the matter and in this connection has relied on a decision of the Hon’ble High Court, Calcutta in C.O. No. 25 of 2013. The appellants have assailed the order dated 5.3.2013 whereby the warrant of arrest against the appellants in execution case has been issued.
3. The learned District Forum has observed that there was reckless conduct of the JDR even after losing the fight upto Hon’ble National Commission and did not comply with the orders passed by the Hon’ble National Commission.
