ORDER :

Noushad Ali, President—This appeal has been preferred by the opposite party-Insurance Company, directed against the order date 30.5.2014 in C.C. No. 2 of 2012 passed by the District Consumer Forum, East Godavari District at Kakinada, awarding a sum of Rs. 2,11,000 towards reimbursement of amount on account of the damage to the plant and machinery of the manufacturing unit of the respondent due to the natural calamity.

2. The respondent herein is a Limited company incorporated under the Companies Act, 1956. It has set up an integrated biodiesel manufacturing unit at Tammavaram village, Kakinada. The company obtained a Standard Fire and Special Perils policy for the buildings, plant and machinery, furniture, fixtures, fittings etc., and electrical installation of the unit at Kakinada besides the furniture, fixtures for their office and electrical installations at Hyderabad.

3. On 12.5.2011 there was an unexpected thunderstorm accompanied by high velocity of winds due to which the roofing sheets and side cladding etc., of the building were damaged.
