ORDER :

Mr. Justice J.M. Malik, Presiding Member-Voltage Limited (Allwyn Unit), Sanath Nagar, Hyderabad is a Public Limited Company. The complainant transacts the business of manufacture and sale of modular office furniture, which is done by Hyderabad Unit of the complainant. On 9.4.1999, the complainant received an order from ICICI Bank Limited, Mumbai for supply and assembly of Modular furniture for their Mumbai Office, copy of the said order is annexed as Annexure No. 1. The total value of the contract was Rs. 3,99,41,087. The complainant obtained insurance policy from National Insurance Company Limited, opposite parties 1 and 2 i.e. its functionaries, Divisional Office and General Manager. The request was made to OP 1 vide Annexure II. The OP insured the goods for a period of 6 months.

2. During the subsistence of the insurance policy, unfortunately, on 29.6.1999, in the office of ICICI Bank Limited at Mumbai office, part of the furniture supplied by the complainant was damaged and destroyed in the fire. The opposite party was informed by letters and its copies Annexures IV a
