ORDER :
Mr. Samaresh Prasad Chowdhury, Presiding Member-The instant complaint under Section 17 (inadvertently mentioned under Section 15) of the Consumer Protection Act, 1986 (for brevity, ‘the Act’) is at the instance of an intending purchaser against a partnership construction firm (Opposite Party No. 1) represented by its partners (Opposite Party Nos.2 and 3) and the landowner (Opposite Party No. 4) on the allegation of deficiency in services on the part of Opposite Parties in a consumer dispute of housing construction.

Succinctly put, Complainant’s case is that on 15.4.2011 he entered into an agreement with the OP No. 1 to purchase a self-contained flat measuring about 725 sq. ft. on the ground floor at the proposed three storeyed new building lying and situated at Holding No. 1107, Srinagar Raod, P.S.-Sonarpur, Kolkata – 700084, Dist- South 24 Parganas within the local limits of Ward No. 1 of Rajpur-Sonarpur Municipality at a total consideration of Rs. 21,00,000. The complainant has stated that he paid a sum of Rs. 4,00,000 as booking money/advance on or before the date of execution of agreement and subsequently he paid the entire consideration amount.
