This Consumer Complaint No. 1275 of 2015 has been filed on 9.10.15 by the complainants – Vinod Gangwal and Pramila Gangwal against the opposite parties – Siroya FM Constructions Pvt. Ltd. & Ors.

2. The complainants, towards purchase of an apartment from the Opposite Parties, initially paid Rs. 1,51,000 as earnest money on 7.9.09, then Rs. 25,50,000 on 17.9.09 after which allotment of Flat 703, on 7th Floor, admeasuring 1,480 sq. ft. was confirmed vide allotment letter dated 8.10.09, against a total consideration of Rs. 79,92,000 . They were also orally granted one car parking space for Rs. 1,20,000. An ‘Agreement For Sale’ between Opposite party No. 1—M/s. SIROYA FM Constructions and the complainants was inked on 18.11.9. This inter alia provided for handing over possession of the apartment on or before August 2010, with a grace period of 3 months. The agreement was duly registered with the office of the Sub-Registrar, Borivali wherein the complainants paid Rs. 4,17,000 towards stamp duty and registration charges.
