This is a complaint filed under Section 17(1)(a)(i) of the Consumer Protection Act, 1986 by the Complainant to direct the opposite parties to remove the name of the complainant from CIBIL; to handover the vehicle; to pay compensation of Rs. 25,00,000 and to pay costs of Rs. 28,000.

2. In brief, the facts of the case, are that the complainant had purchased Honda Activa Electric bearing Registration No. TS02EF7857 by Engine No. 67768 and chassis No. 67625. For the said purchase complainant had obtained loan of Rs. 45,500 from opposite parties. As per the Hire Purchase Agreement complainant was to repay said loan into 23 equal EMI of Rs. 2,398. While entering into agreement the complainant have opted the mode of payment by way of ECS and submitted 23 post-dated cheques of Rs. 2,398 for every month. The opposite party No. 1 has to deposit the cheques on 5th of every month towards EMI.

3. As the matter stood thus, the opposite party No. 1 in the months of January 2015, January 2016 and February 2016, the complainant received calls from the opposite party No. 1 that the complainant is at default for the said months for that the complainant informed them that
