Held: The State Commission) dated 21.05.2020 in EA/23/2020 alongwith MA/145/2020 in CC No.124/2017, whereby the State Commission allowed the M.A. and directed that amount of Rs.13,31,250/- deposited by the Judgment Debtor/Sartaj Cooperative House Building Society alongwith accrued interest be released in favour of Decree Holders, namely Mr. C.L. Singla & Mrs. Darshana Singla in equal share, subject to their furnishing one surety in the amount of Rs.14 Lakhs to the satisfaction of the Secretary of the State Commission.
Appellants/Decree Holders had filed MA/145/2020 before the State Commission seeking release of an amount of Rs.13,31,250/- alongwith accrued interest. State Commission had allowed the application with the condition that the Decree Holders shall furnish one surety of Rs.14 Lakhs to the satisfaction of the Secretary of the State Commission. Since the Appeal against the order dated 11.08.2017 passed in CC/124/2017 is pending before this Commission, State Commission was justified in imposing the condition while allowing the application of the Decree Holders. If the Decree Holders wish to receive the amount of Rs.13,31,250/- in terms of the order dated 21.05.2020, they have to fulfill the condition. Moreover, the impugned order dated 21.05.2020 is an interim order and the execution proceedings are still going on.
For the foregoing discussion, I do not find any illegality or infirmity in the impugned order, warranting interference in the Appellate jurisdiction. Appeal is accordingly dismissed. (Paras 1, 7 & 8)
Result: Appeal dismissed.
