Aggrieved by the order dated 19.06.2015 whereby they have been directed to refund price of two Apollo Tyres, amounting to Rs. 44,000/-, with interest at the rate of 9% per annum from the date of filing of complaint to the date of the payment of aforesaid amount of money and also to pay Rs. 5,000/- as cost of complaint, appellant M/s. Apollo Tyres Limited has preferred this appeal.
2. Facts relevant for the disposal of the complaint may be noticed. Respondent No.1, Krishan Lal owned a truck, which according to the averments made in the plaint is driven by him personally to earn his livelihood. He purchased two new Apolla Tyres from respondent No.2, Happy Tyres, who was authorised dealer/distributor of the Apollo Tyres manufactured by the appellant, on 24.05.2012 against Voucher Annexure-C3. Both the tyres burst when the truck on which they were fitted had covered a distance of only 8,950 Kilometers, though normally the tyres, manufactured by the appellant are supposed to run for not less than 40,000 kilometres.
