Appellant has assailed the order dated 30.11.2015, of learned District Consumer Disputes Redressal Forum, Shimla, whereby a complaint, under Section 12 of the Consumer Protection Act, 1986, filed against him by respondent, Arvind Kumar Sood, has been allowed and a direction is given to him to restore the water supply to the shop of respondent, within thirty days, with further direction to pay Rs. 5,000/- on account of punitive damages and Rs. 1,000/- on account of litigation expenses.
2. Admitted facts are that the respondent is owner of Shop No.28, Chotta Shimla and he has his residence also in the said premises. Appellant has been supplying water to the premises of respondent through the main supply line. According to the respondent, on 10.01.2014, a contractor, engaged by the appellant, started digging road for laying a new main water line and in that process, the pipe carrying water to the premises of respondent was damaged and because of damage, water started leaking.
