ORDER
Heard the learned counsel for the appellant. Learned counsel for the respondent no.2 is present.
2. This appeal is filed U/S-15 of erstwhile Consumer Protection Act, 1986 (herein-after called the Act). Hereinafter, the parties to this appeal shall be referred to with reference to their respective status before the learned District Forum.
3. The case of complainant, in nutshell is that the complainant’s husband had taken a personal accident cover insurance policy from OP No.2 through OP No.1 for sum assured of Rs.1,00,000/-. During currency of the policy the policy holder died in train accident on 21.08.2004. Thereafter the complainant being nominee approached the Ops but the OP did not settle the matter. Hence, the complaint.
4. The OP No.1 filed written version stating that the policy holder who is the husband of the complainant has purchased policy from OP No.2 through OP No.1 for a period from 15.05.2002 to 14.05.2017. It is the case of OP No.1 that after receiving all the claim form documents forwarded to OP No.2 on 09.11.2005 for necessary settlement because it was Memorandum of Understanding between OP No.1 & 2 for settlement of claim of group members of OP No.1 by OP N
