ORDER
A.Z. Khwaja, Judicial Member—Appellant M/s. Goodyear India Ltd., has preferred the present appeal feeling aggrieved by the judgment and order dated 15/03/2002 passed by the District Consumer Disputes Redressal Commission, Satara in Complaint No.7 of 2001, whereby the learned District Consumer Commission allowed the complaint filed by the respondent/original complainant – Shri Baban Ganpat Shinde and directed the appellant/original opponent no.3 along with other opponents to replace the tyres of tractor and also to pay compensation of Rs.5,000/- towards mental and physical harassment as well as Rs.2,000/- as costs of litigation. Appellant and respondents shall be referred by their original nomenclature.
2. Short facts giving rise to the present appeal may be stated as under: Complainant – Shri Baban Ganpat Shinde claims to be resident of Village Limb, Taluka and District Satara. Complainant claims to be a farmer and for the purpose of cultivation his farm and by way of serving livelihood the complainant approached the Opponent Nos.1 and 2, namely, M/s. Mahindra & Mahindra Ltd., who were the dealers for purchase of Mahindra Tractor. The complainant purchased one tractor of M/s.
