The Consumer Protection Act, 1986 – Deficiency in Service – Section 2(11) – Insurance – Section 2(1)(g) of the 1986 Act – Standard Fire and Special Perils Policy – Wrongful Repudiation of Claim – Salvage Value Calculation – Correction of Arithmetical Error – Complainants (M/s Mauli Textiles and a cooperative society) purchased “Standard Fire and Special Perils Policies” from United India Insurance for cotton bales stored in their godowns – Insured goods were pledged to a cooperative bank against loan facilities – On July 12, 2009, a fire broke out due to an alleged short circuit, destroying the majority of the 261 cotton bales – Insurance Company repudiated the claims on March 31, 2010, asserting the fire was not accidental, the goods had no market value, and the documents were fabricated – State Commission ruled in favor of the Complainants, finding the repudiation unjustified – In calculating the final compensation, the Commission made a mathematical error by deducting the salvage rate from the entire batch of damaged goods rather than just the saved goods – NCDRC upheld the State Commission’s finding that the repudiation was entirely unjustified – The fire was accidental (supported by electrical inspector reports), and the goods held economic value – NCDRC ruled in favor of the Complainants regarding the calculation error – It corrected the State Commission’s mistake, ruling that salvage value must strictly be deducted only for the quantity of goods actually salvaged, not the entire damaged stock – Insurance Company was directed to pay revised compensation amounts (Rs.34,96,573.44 and Rs. 31,12,014) with 6% interest, plus litigation costs.
JUDGMENT
AVM J. Rajendra, AVSM VSM (Retd.), Presiding Member.—The Appellants filed the instant First Appeal against the Order dated 7.2.2014 passed by the learned State Consumer Disputes Redressal Commission, Maharashtra (“State Commission”) in Consumer Complaints No.11/2011 and No.12/2011, wherein the State Commission partly allowed the Complaints.
2. As per the record of the Registry, both FA/565/2014 and FA/566/2014 have been filed with a delay of 154 days. The same are condoned in the interest of justice.
3. For convenience, the parties in the present matter are being referred to as per position held in the Consumer Complaint.

Brief facts of the case, as per the complaints, are that the Complainants in in CC/11/2011 and CC/12/2011 had obtained a “Standard Fire and Special Perils Policies” covering cotton bales stored in four godowns situated within the Complainant society premises in CC/12/2011. Godown Nos.3 and 4 were used by M/s. Mauli Textiles i.e. complainant in CC/11/2011, whereas Godown Nos.1 and 2 were used by the Complainant Society. M/s. Mauli Textiles obtained Policy No.230500/11/00000917 valid from 20.10.2008 to 19.10.2009 for a sum insured of Rs.75,00,000. The Complainant Society obtained Policy No.230500/11/08/11/00000800 valid from 19.9.2008 to 18.9.2009 for Rs.50,00,000 and Policy No.230500/ 11/09/11/00000109 from 17.4.2009 to 16.04.2010 for Rs.20,00,000. It is the Complainants case that M/s. Mauli Textiles had obtained loan facilities from OP-3 by pledging 133 cotton bales lying in Godown Nos.3 and 4. Pursuant to which, the said godowns were sealed and the goods were taken into custody by OP-3 i.e. Co-operative Urban Bank acting as agent of OP-1 and 2 Insurer. Similarly, the Society had obtained loan facilities from OP-3 by pledging 128 cotton bales in Godown No.1 &2, which were also sealed by OP-3. According to the Complainants, on 12.7.2009 at 4:30 AM, the watchman noticed smoke emanating from all four godowns and informed Shri Narendra Patil, Chairman of the Society, who thereafter informed the Manager of OP-3, police authorities and Fire Brigade and rushed to the spot. They alleged that the fire occurred due to a short circuit in Godown No.4 and thereafter spread to the remaining godowns. During the firefighting operations, the seals, locks and tin sheets of the roofs were removed to facilitate access. Out of a total of 261 cotton bales, only 51 bales could be saved. The police, Tahsildar, MSEB staff, officers of OP-3 and Insurer visited the spot and a panchanama was made. On receipt of intimation of the incident, OP-1 appointed Surveyor Shri Ashok Motiani and Investigator Ms. Monica Arland, who visited the site on 13.7.2009 and conducted inquiry. Shri Ashok Motiani submitted his report on 7.9.2009 stating that the fire occurred in mysterious circumstances. Whereas according to the Complainants, MSEB authorities opined that the fire occurred due to a short circuit in the electrical wiring in Godown No.4. Thereafter, they submitted their claims on 4.8.2009 claiming Rs.50,12,600 and Rs.50,26,344 respectively. OP-1 further appointed Surveyor Shri S.S. Malpani for assessment of damages. He sent burnt cloth samples to Bombay Textile Research Association (BTRA). In its report dated 10.8.2010, BTRA observed that the cloth had not undergone undue deterioration in its strength and could still fetch value in the market. OP-1 also appointed another Surveyor, Shri Alok Shankar who filed his report on 18.3.2010. Thereafter, OP-1 repudiated the both the claims vide letter dated 31.3.2010 on the grounds that the fire was not accidental in nature, the goods were old and had no economic value, and the records relating to the incident were forged.
5. Aggrieved by the repudiation of their claims, the Complainants filed separate Consumer Complaints seeking payment of Rs.50,12,600 and Rs.50,26,433 respectively towards loss caused due to the fire. The Complainant Society also sought restraint against recovery of the loan
