( 1 ) ). The aforesaid appeals have been filed by the State of Gujarat against the common judgment and decrees passed in the Civil Suits Nos. 3001, 3010 and 3011 of 1972 passed by the learned Judge of the City Civil Court, court No. 2. Ahmedabad, on 1-4-1978.

In Civil Suit No. 3001 of 1972 decree was passed in favour of the plaintiff and against the defendant for a sum of Rs. 30,617. 00 with interest at the rate of 6% per annum on that amount from the date of the suit till the date of the decree and at the same rate and on the same amount from the date of decree till realisation. The defendant was ordered to bear its own costs and would bear the costs of the plaintiff to the extent the plaintiff has succeeded. The plaintiff was ordered to bear his costs to the extent he has failed.

In Civil Suit No. 3010 of 1972 decree is passed in favour of the plaintiff and against the defendant for a sum of Rs. 27,744. 00 with six percent interest on that amount from the date of the suit till the date of decree and at the same rate and on the same amount from the date of decree till realisation.
