( 1 ) THE petition challenges inaction on the part of the respondents in not appointing the petitioner on the post of Lecturer in Psychology in Gujarat Education Service Class-II (Collegiate Branch) at Government Arts, Science and Commerce Colleges.

( 2 ) THE Gujarat Public Service Commission ("the GPSC" for brevity) issued advertisement inviting applications for appointment to the posts of Lecturer in Psychology in Gujarat Education Service Class-II (Collegiate Branch) at Government Arts, Science and Commerce Colleges. 12 posts were advertised, out of which 6 posts were reserved for SC/st/sebc candidates and the remaining 6 posts were for open merit candidates. By notice dated 19. 5. 2000, the GPSC published the select list and the waiting list. It appears that initially the select list consisted of 11 names and the result of one of the candidates was kept in abeyance. The Court is informed that subsequently Smt Nilamben Natvarlal Nakum, whose result was kept in abeyance was included in the select list at Sr. No. 8a. That is why the final select list dated 6. 7. 2000 consisted of 12 names for the 12 posts of Lecturer in Psychology. There is also no dispute about the
