This Second Appeal, filed under Section 100 of the Civil Procedure Code, is directed against the judgment and order dated 18th October, 2010 passed by the learned Additional District Judge, Ahmedabad (Rural), (hereinafter be referred to as “the Lower Appellate Court”) in Regular Civil Appeal No.62 of 2005, whereby it has confirmed the judgment and decree dated 23.10.1981 passed by the learned Civil Judge (S.D.), Narol (hereinafter be referred to as “the Trial Court”) in Special Civil Suit No.175 of 1979.
