JUDGMENT :

1. Heard learned Advocate Mr. Ramnandan Singh for the appellant accused and learned Additional Public Prosecutor Ms. C.M. Shah for the respondent - State.

2. By way of this Appeal, the Appellant accused has, being aggrieved, challenged the judgment and order of conviction and sentence dated 09.12.2009 of the learned Principal Sessions Judge, Bharuch in Sessions Case No. 100/2008 whereby the appellant herein was convicted and sentenced to undergo punishment of life imprisonment and fine of Rs. 3,000/-, in default simple imprisonment for one year under Section 302 of the Indian Penal Code, rigorous imprisonment for two years and fine of Rs. 2,000/-, in default simple imprisonment for six months under Section 201 of the Indian Penal Code and rigorous imprisonment for one year and fine of Rs. 1,000/-, in default simple imprisonment for three months under Section 379 of the Indian Penal Code.

3. The case in brief is as under:--
