1. Rule returnable forthwith. Ms. Thakore, the learned Additional Public Prosecutor waives service of notice of rule for and on behalf of the respondents.
2. By this application under Section 482 of the Code of Criminal Procedure, 1973, the applicants-original accused persons seek to invoke the inherent powers of this Court, praying for quashing of the proceedings of the Criminal Case No. 789 of 2016 pending in the Court of the learned 2nd Additional Chief Judicial Magistrate, Dahod arising from a complaint lodged by the respondent No. 2 herein for the offence punishable under Sections 18(c) read with 27 of the Drugs and Cosmetics Act, 1940.
3. The case of the complainant may be summarised as under:
3.1 The applicants before me are the "Trustees" of a Public Charitable Trust, running in the name of "Daweso Welfare Trust." It is engaged in the business of promoting educational, social and sports activities as well as extending medical services to the people hailing from poor and downtrodden class of the society.
