ORDER ;

A.Y. KOGJE, J.

1. The present application is filed for modification of condition with a prayer to set aside the order passed by the Sessions Court, Mehsana in Criminal Misc. Application No. 809 of 2016 dated 27.09.2016, where the application for release of passport for a period of one year which was surrendered to the concerned Court as a condition of release on bail, is rejected.

2. Learned advocate for the applicant submits that for the time being the applicant needs the passport for temporary period so as to enable him to apply for further studies abroad.

3. Learned advocate for the applicant draws the attention of this Court to the order passed earlier by the Sessions Court where the passport was released for the temporary period and that the applicant has thereafter, complied with the condition for temporary release and thereafter has surrendered the passport with the concerned Court.

4. Learned APP objects to release the passport as the applicant has not tendered any documents pertaining to his further studies abroad.

5. Having considered the aforesaid facts, more particularly, when the applicant's passport was released in the year 2015, for the purpose of obtaining VISA an
