1. By this application under Article 227 of the Constitution of India, the applicant-original accused No.1, calls in question the legality and validity of the order dated 16th December, 2017 passed by the 11th Judicial Magistrate, First Class, Ahmedabad (Rural) upon a remand application filed by the Investigating Agency in connection with the first information report being C.R. No.I-97 of 2017 registered at the Vastrapur police station, Ahmedabad for the offence punishable under sections 406, 420, 467, 468, 469, 471 and 120B of the Indian Penal Code.
2. It appears from the materials on record that the applicant herein, apprehending arrest at the hands of the police in connection with the first information report, referred to above, came before this Court and prayed for anticipatory bail by filing the Criminal Misc. Application No.24868 of 2017. A Coordinate Bench of this Court allowed the anticipatory bail application vide order dated 28.11.2017. The order reads thus;
