Headnote:

Indian Penal Code, 1860 – Sections 306 and 114 – Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 - Section 14(A)(2) - Appellant – original accused for anticipatory bail – Informant Gitaben, wife of Vinodbhai Solanki has lodged the FIR against one Kaushalyaben, her husband, her daughter, her younger son, her son-in-law and one Fatehdan Gadhavi alleging that her husband has committed suicide and he wrote a suicide note, wherein he has named all these persons as responsible for his commission of suicide. It also reveals from the contents of the FIR that there was some dispute between Kaushalyaben and the deceased and Kaushalyaben has lodged one complaint against the deceased and for that purpose, some settlement was going on. It also reveals that in the suicide note, there is also name of one PSI who has registered the FIR against the deceased – Held, there is a dispute between Kaushalyaben and the deceased and Kaushalyaben has lodged complaint against the deceased. Therefore, the question of pressing for settlement is irrelevant. On perusal of the police papers made available to this Court, it also appears that there was some dispute between Kaushalyaben and the deceased. It also appears from the record that Kaushalyaben has lodged the complaint against the deceased and his relatives and for that they were arrested and were kept in jail for 13 days and thereafter, they were released. Considering the overall material, without discussing the evidence in detail, it appears that there is a doubt as to commission of the offence under the Atrocity Act against the present accused – This is a fit case wherein discretionary power under Section 438 of the Code of Criminal Procedure could be exercised in favour of the present appellant – Appeal disposed of
