ORDER :
Rule. Learned APP waives service of rule for the respondent-State.
1. The convict is before this Court, urging that he had preferred an application under Section 432 of the Code of Criminal Procedure, 1973, which came to be rejected by the Home Department and being aggrieved with the same, he has preferred Special Civil Application No. 7483 of 2017, which is pending, and therefore, he is entitled to long parole leave. It is also urged that the learned Advocate representing the petitioner in the aforesaid matter has expired and he needs to engage another advocate. It is, therefore, urged that on that count also this Court may show indulgence.
2. In support of his say, he has placed reliance on the decision of the Apex Court in Criminal Appeal No. 171 of 2016, Dated: 29.06.2016, in the case of ‘STATE OF GUJARAT AND ANOTHER Vs. LAL SINGH @ MANJIT SINGH & OTHERS’, where, the Apex Court was considering the challenge to the judgment and order dated 23.08.2012, passed by the High Court of Punjab and Haryana at Chandigarh in Criminal Writ Petition No. 1620 of 2011, whereby, the High Court, while entertaining the Writ Petition had opined that the order dated 26.07.2011 passed by the Go
