A.P. THAKER, J.
1. The appellant-original accused has preferred this appeal under Section 374 of the Criminal Procedure Code, 1973 against the judgment and order dated 8.8.2002 passed by learned Additional Sessions Judge, Bharuch in Sessions Case No. 59 of 1997, whereby the appellant-accused was convicted for the offence under Sections 363, 366 and 376 read with Section 114 of the Indian Penal Code. The appellant was sentenced to undergo rigorous imprisonment for a period of one years and ordered to pay Rs. 200/- fine for offence under Section 363 read with Section 114 of the Indian Penal Code and in default of payment of fine, further simple imprisonment of one month was imposed. The appellant was sentenced to suffer rigorous imprisonment for three years and ordered to pay fine of Rs. 500/- for offence under Section 366 read with Section 114 of the Indian Penal Code and in default of payment of fine, simple imprisonment for a period of two months was imposed. The appellant was sentenced to suffer rigorous imprisonment for five years and ordered to pay fine of Rs. 700/
