JUDGMENT :

1. In this petition, which is filed under Article 226 of the Constitution of India, the petitioner has prayed that the respondent-Police authority be directed to register an FIR as per the complaint dated September, 2019 filed by the petitioner, copy of which is placed on record at Page No. 12 of the compilation.

2. Heard learned advocate, Mr. Haresh Trivedi appearing for the petitioner and learned APP Mr. Dabhi for the respondent-State of Gujarat.

3. It is submitted by learned advocate for the petitioner after referring to the averments made in the memo of petition as well as written complaint produced on record that though the said complaint is sent to the respondent no. 4, till date no action is taken by the respondent no. 4 pursuant to the said written complaint for filing of the FIR against the concerned accused. Learned advocate has, therefore, urged that appropriate direction be issued to the respondent-Police authorities for registration of the FIR considering the decision rendered by the Hon'ble Supreme Court in the case of Lalita Kumari v. State of Uttar Pradesh and others reported in (2014) 2 SCC 1.

4. On the other hand, learned APP has opposed th
