JUDGMENT :

1. Rule returnable forthwith. Mr. Utkarsh Sharma, learned Assistant Government Pleader waives service of notice of Rule for the respondents.

2. Heard learned advocates for the respective parties and perused the record.

3. Mr. Barot, learned counsel for the petitioner would rely on an order passed in similar matter by this Court namely; Special Civil Application No.20333 of 2019 dated 13.09.2022. He further requested this Court to pass a similar order in this matter too. The order dated 13.09.2022 reads as under :

“1. Mr. Vasant Barot, learned counsel for the petitioner, would rely on a decision of this Court, passed in Special Civil Application No. 3204 of 2020 dated 30.08.2022.

2. In light of the aforesaid decision and the fact that this Court had relied on the decision rendered in Special Civil Application No. 15391 of 2011 and passed the order in the aforesaid Special Civil Application being Special Civil Application No. 3204 of 2020, learned counsel for the petitioner prays that the petitioner’s case be considered in light of the decision rendered in Special Civil Application No. 15391 of 2011 dated 31.08.2017, which is extensively reproduced in Special Civil Application
